The terms and conditions below are legally binding on you as a user of the CASHFORYOURGOLD® our service, the CASHFORYOURGOLD web site(s), and/or as a customer of Pasadena Jewelry & Loan, Inc and inure to the benefit of Pasadena Jewelry & Loan, Inc and its successors and assigns.
All customers are required to be over twenty-one years of age in order to sell precious metals or jewelry to Pasadena Jewelry & Loan, Inc . All customers must be legal owners of said property that is sold to us or attempted to be sold to us. Every customer must be acting on their own behalf not as an agent or representative of another party.
Pasadena Jewelry & Loan, Inc may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph. By shipping your items to Pasadena Jewelry & Loan, Inc , you are agreeing to all of our terms and conditions set forth and herein and those described on our website, CASHFORYOURGOLD.COM.
Pasadena Jewelry & Loan, Inc will guaranty against loss of the total contents properly and legally shipped to Pasadena Jewelry & Loan, Inc in accordance with the instructions and procedures established by Pasadena Jewelry & Loan, Inc and subject to the terms and conditions as described by CASHFORYOURGOLD.COM.
Pasadena Jewelry & Loan, Inc reserves the right, in its discretion to reject delivery of any mail, envelope or package which appears to have been opened, damaged, or tampered with. Any such mail item will be returned by the post office to the customer. Pasadena Jewelry & Loan, Inc shall have no liability to any customer or client for any attempted delivery or return of such items.
This limitation of liability shall be binding on all customers, any third party, including but not limited to, the customer and the customer’s successors, assigns, insurance carriers and any individual or entity asserting any right or claim relating to the customer’s transaction with Pasadena Jewelry & Loan, Inc. In no event shall Pasadena Jewelry & Loan, Inc be liable for any damages from the loss or destruction of property in its possession for any reason, including negligence. In no event shall Pasadena Jewelry & Loan, Inc be liable to any third party, including any insurance carrier. Pasadena Jewelry & Loan, Inc shall not be liable for any subrogation claim brought by the customer’s insurance carrier, and by submitting items to Pasadena Jewelry & Loan, Inc , a customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier. Pasadena Jewelry & Loan, Inc ’s liability is and shall be expressly and specifically limited to the least of the following sums:
The customer/seller expressly acknowledges and agrees that if there is no appraisal which was issued prior to the contents being submitted to Pasadena Jewelry & Loan, Inc , the liquidated value shall be conclusive and binding and in no event shall Pasadena Jewelry & Loan, Inc’s liability exceed one hundred dollars.
Pasadena Jewelry & Loan, Inc shall not be liable to anyone for any damages, included but not limited to, consequential, punitive, incidental, loss of profit or opportunity, other than set for herein above. By submitting items, customer explicitly and expressly accepts the limitation of liability. If you believe your items submitted to us for sale exceed the amount of one hundred dollars we recommend that you insure your package separately. We also would advise you to list your items on the brochure that was mailed to you.
If an item is returned to a customer, Pasadena Jewelry & Loan, Inc will insure the item for no more than the amount offered by Pasadena Jewelry & Loan, Inc regardless of what it was insured for when mailed by the customer to Pasadena Jewelry & Loan, Inc’s facilities, unless Pasadena Jewelry & Loan, Inc is otherwise notified by email or fax by the customer prior to the return shipment and the customer agrees to pay for any extra insurance requested. Pasadena Jewelry & Loan, Inc shall in its sole discretion, choose the return carrier, insurance, and receipt verification method for each transaction.
This agreement shall be governed by the laws of the State of California without regard to its conflict of law provisions. Pasadena Jewelry & Loan, Inc ’s failure to exercise or enforce any right or provision of the agreement will not be deemed to be a waiver of such rights or provisions. If any provision of the agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the agreement remain in full force and effect. You agree that regardless of any statue or law to the contrary, any claim or cause of action arising out of or related to the use of services offered by Pasadena Jewelry & Loan, Inc must be filed within one year after such claim or cause of action arose or forever barred. Any such claim or cause of action must be filed in the State of California. Pasadena Jewelry & Loan, Inc shall be entitled to reimbursement for any and all costs incurred by it in defending and civil action filed or attempted to be filed in any jurisdiction outside the State of California, including but not limited to, attorney’s fees incurred by Pasadena Jewelry & Loan, Inc .
If you change your mind about selling your items or are unsatisfied with the amount of the payment you received, you must notify us immediately. If we do not hear from you by telephone or fax within ten (10) days of the date on the check we mailed to you, your items will be processed by us and either melted or resold. You must return the check before we will return your items. The time limitation cannot be waived for any reason.
If Pasadena Jewelry & Loan, Inc receives your phone call within such ten (10) day period, then after receiving your check Pasadena Jewelry & Loan, Inc will return your Item(s), without charge to you, within fifteen (15) business days.
Pasadena Jewelry & Loan, Inc will not be responsible for any loss or damage of any kind if the time limitation is not followed.
